Swimformation Limited (“Swimformation”) has an agreement with Swimming New Zealand (“SNZ”) whereby certain services designed and owned by Swimformation can be accessed on and through the SNZ website using New Zealand Swim Fitness Programmes.  These Swimformation pages carry the "look and feel" of the Swimming New Zealand, however they are on a server controlled by Swimformation Limited

This Website Privacy Statement relates to the collection of, and provision to SNZ of your personal details through subscribing to the Swimformation services.   Swimformation, not SNZ, is responsible for the content and application of this Website Privacy Statement.

Information Collection & Use

Registration

In order to use this website, you must first complete the online registration form and provide a user name and password.  During registration you are required to give contact information such as your name, email address and other information that is necessary for the Swimformation service. Swimformation uses this information to contact you about Swimformation services in which you have expressed interest, to email material to you for which you have requested delivery by email and to create personalised swim training programmes.

By registering for the Swimformation services you also agree to become a recreational member of SNZ. There is no additional charge for this membership. SNZ provides certain services to its recreational members and by registering for the Swimformation services you agree to receive from SNZ the same services communications and benefits as other existing recreational members currently do. In order to deliver these services, which are described on the Swimming New Zealand website, SNZ may contact you from time to time. You are encouraged to acquaint yourself with the implications of becoming a recreational member of Swimming New Zealand

Swimformation is the sole owner of the information collected from you when subscribing, but only your name and contact details will be provided to SNZ.

Registration

If you register for Swimformation services, Swimformation needs certain personally identifiable information. You must provide contact information such as name and email address, and for some Swimformation services financial information such as credit card number and expiration date.

Swimformation uses this information for billing purposes.  If Swimformation has trouble processing your registration Swimformation will use this information to contact you.

When you register you will be asked if you wish to receive certain information by email.

Uses of Information

The information provided by you will be used to create personalised swim training programmes. These programmes can be created for 8 days with a maximum of 2 per day (your Schedule). Your personal log records the programmes you have created and completed (your Personal Log). A summary of your seasonal activity is compiled from the completed programmes (your Seasonal Analysis). You are able to create programmes using Swimformation technology, modify these programmes and you are asked to provide feedback after a programme has either been swum or abandoned. These services are personal to you.

Swimformation will aggregate and publish data such as the total distances swum using Swimformation programmes and the distances swum per stroke type. Swimformation will undertake other statistical analysis of the aggregate data. Your personal information will not be personally identified in this aggregate data.

Communications from the Site

Special Offers and Updates

Swimformation will occasionally send you information on new services and special deals. You can sign up for these emails from us on the Swimformation registration page.

Out of respect for your privacy you have the option not to receive these types of communications. You can ‘opt-out’.

Service-related Announcements

Swimformation will send you strictly service-related announcements on occasions when it is necessary to do so.  For instance, if our service is temporarily suspended for maintenance, Swimformation might send you an email.

Generally, you may not ‘opt-out’ of these communications, which are not promotional in nature.

Customer Service

Based upon the personally identifiable information you provide us, Swimformation may send you a welcoming email to verify your username and password.  Swimformation will also communicate with you in response to your inquiries, to provide the services you request, and to manage your account. Usually, Swimformation will communicate with you by email.

Profile

Swimformation stores information that it collect through cookies to create a “profile” of your preferences.  Swimformation may tie your personally identifiable information and your registration history to information in the profile, in order to provide tailored promotions and marketing offers and to improve the content of the site for you.  Swimformation does not share your profile with third parties other than SNZ.

Information Sharing and Disclosure

Personally identifiable information  Swimformation shares your name and contact details with SNZ for purposes described at the beginning of this statement. Swimformation DOES NOT share personally identifiable information with any other third parties.

Legal Disclaimer

Swimformation reserves the right to disclose your personally identifiable information as required by law and when Swimformation believes that disclosure is necessary to protect its rights such as payment obligations and/or to comply with a judicial proceeding, court order, or legal process served on the website.

Choice/Opt-out

Swimformation provides you the opportunity to ‘opt-out’ of having your personally identifiable information used for certain purposes, when Swimformation asks for this information.  For example, if you register for the Swimformation services but do not wish to receive any additional marketing material from us, you can indicate your preference on the registration page.
You can ‘opt-out’ at anytime.

Log Files

Swimformation gathers certain information automatically and stores it in log files.  This information includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data.  Swimformation uses this information, which does not identify individual users, to analyze trends, to administer the site, to track users’ movements around the site and to gather demographic information about our user base as a whole.

Swimformation does not link this automatically-collected data to personally identifiable information.

Cookies

A cookie is a small text file that is stored on a user’s computer for record-keeping purposes. Swimformation uses cookies on the Swimformation pages because the Swimformation service needs these to deliver your personalised Schedule and Personal Log.

Swimformation uses session ID cookies to make it easier for you to navigate the site. For example Swimformation uses session ID cookies to deliver you Schedule and Personal Log to you. A session ID cookie expires when you close you browser.

If you reject cookies, you may still use Swimformation services, but your ability to use many areas will be limited.

The Swimformation pages contain links to the SNZ site. That site is not owned or controlled by Swimformation. Please be aware that Swimformation is not responsible for the privacy practices of SNZ.

Swimformation encourages you to be aware when you leave the Swimformation pages to read the website privacy statements of each and every website that collects personally identifiable information.

This Website Privacy Statement applies only to information collected by the Swimformation pages.

Access to Personally Identifiable Information

If your personally identifiable information changes, or if you no longer desire our service, you may correct, update or delete it at any time.

Security

The security of your personal information is important.  When you enter sensitive information such as credit card number and/or social security number on our registration page, Swimformation encrypts that information using secure socket layer technology.

Swimformation follows generally accepted industry standards to protect the personal information submitted to us, both during transmission and once Swimformation receive it.  No method of transmission over the Internet, or method of electronic storage, is 100% secure.  While Swimformation uses commercially acceptable means to protect your personal information, Swimformation cannot and does not guarantee its absolute security.

Business Transitions

In the event Swimformation goes through a business transition, such as a merger, acquisition by another company, or sale of all or a portion of its assets, your personally identifiable information almost certainly will be among the assets transferred.  You will be notified either via email and/or prominent notice on the website for 21 days of any such change in ownership or control of your personal information.

Changes in this Website Privacy Statement

If Swimformation decides to change the Swimformation privacy policy, Swimformation will post those changes to this Website Privacy Statement, the homepage, and other places Swimformation deems appropriate so that you are aware of what information Swimformation collect, how Swimformation use it, and under what circumstances, if any, Swimformation discloses it. Changes will be highlighted for at least 21 days. Swimformation reserves the right to modify this Website Privacy Statement at any time, so please review it frequently .
